Terms of Service

These Terms of Service govern your use of the Cascade Pivot website and services. By accessing this site or engaging our services, you agree to the terms described below. Last updated: May 2025.

Scope and acceptance

These Terms of Service apply to all visitors and users of the Cascade Pivot website, as well as to clients who engage our recipe planning, meal strategy, and cooking workshop services. By continuing to use the site or by booking a service, you confirm that you have read and agree to these terms.

If you do not agree to any part of these terms, please do not use this website or engage our services.

Service usage

1. Permitted use

This website and its content are provided for personal, non-commercial use. You may browse pages, read content, and submit enquiries through the contact form. You may not reproduce, redistribute, or commercially exploit any content from this site without prior written permission from Cascade Pivot.

2. Prohibited uses

The following activities are not permitted:

  • Scraping, harvesting, or systematically copying content from this website
  • Attempting to access systems, databases, or infrastructure beyond normal site usage
  • Submitting false or misleading information through the contact form
  • Using the site in any way that could damage its reputation or interfere with its operation

3. Service access requirements

Some services require you to be 18 years of age or older, or to have the capacity to enter into a binding agreement. By engaging a service, you confirm that you meet these requirements.

4. Fair usage

Clients engaging our recipe planning or strategy services are expected to use the materials and advice provided for personal household use only. Redistribution of personalized plans, menus, or recommendations for commercial purposes is not permitted without express written agreement.

Account and service engagement

5. Enquiries and bookings

Submitting the contact form does not constitute a booking or binding agreement. A service engagement begins only when both parties have confirmed the scope, timeline, and fee in writing.

6. Cancellations and changes

Specific cancellation and rescheduling terms are agreed upon at the time of service booking. We will always communicate changes clearly and with reasonable notice.

Service availability

7. Website availability

We make reasonable efforts to keep this website available and functioning. However, we cannot guarantee uninterrupted access and reserve the right to take the site offline for maintenance or updates with or without notice.

8. Service modifications

Cascade Pivot reserves the right to modify, update, or discontinue any service offering at any time. If you have an active booking, any material changes affecting your engagement will be communicated directly.

9. Geographic availability

Cascade Pivot primarily operates in Japan. Online services are available to clients in other regions, though time zones and scheduling will reflect Japan Standard Time (JST) unless otherwise agreed.

Intellectual property

10. Website content ownership

All content on this website — including text, images, graphics, and structure — is the property of Cascade Pivot or its licensors. You may not reproduce, copy, or distribute any part of it without written permission.

11. Personalized materials

Menus, recipes, plans, and written materials created specifically for you as part of a service engagement are provided for your personal household use. They may not be sold, published, or redistributed.

12. Trademarks

The Cascade Pivot name and associated brand elements are the property of Cascade Pivot. Nothing in these terms grants any right to use them without prior written consent.

Changes to these terms

Cascade Pivot may update these Terms of Service from time to time. Revised terms will be posted on this page with an updated date. Continued use of the website or services after changes are posted constitutes acceptance of the new terms. If you have an active service engagement, material changes will be communicated directly.

Service availability, modifications and force majeure

Cascade Pivot provides its services on a reasonable-endeavours basis. While we work to keep our website and consultation channels available, scheduled maintenance, dependency outages (hosting, telephony, payment processors), public-holiday closures and events of force majeure (including but not limited to natural disasters, infrastructure failure, public-health emergencies and government action) may interrupt availability without prior notice. We will not be liable for damages arising from such interruptions, and any pre-paid sessions affected by a confirmed outage will be rescheduled or refunded pro-rata in line with our cancellation policy.

Intellectual property, content licence and acceptable use

All text, photographs, layouts, illustrations, code and trademarks displayed on this website are the property of Cascade Pivot (or our licensors) and are protected under Japanese copyright and trademark law as well as international treaties. You are granted a limited, non-exclusive, non-transferable licence to view and print pages for personal, non-commercial use only. You may not (a) reproduce, redistribute, mirror or publicly display our content in any form without our prior written permission; (b) use our content to train machine-learning models without an explicit licence; (c) submit content via our forms that is unlawful, defamatory, harassing or that infringes third-party rights; or (d) interfere with the security or integrity of our site (including probing, scanning or attempting to bypass authentication).

Governing law, dispute resolution and severability

These Terms are governed by the laws of Japan, excluding its conflict-of-law provisions. The Tokyo District Court shall have exclusive jurisdiction of first instance over any dispute arising from your use of Cascade Pivot, unless mandatory consumer-protection laws in your place of residence direct otherwise. Before formal litigation, both parties agree to attempt good-faith resolution through written correspondence for at least thirty (30) calendar days. If any provision of these Terms is held invalid or unenforceable by a competent court, that provision shall be struck only to the extent necessary, and the remainder shall continue in full force and effect.
